Federal Court Upholds FRA's Two-Person Train Crew Rule

On August 11, 2026, the U.S. Court of Appeals for the Eleventh Circuit upheld the Federal Railroad Administration's (FRA) two-person train crew rule, rejecting challenges brought by the Association of American Railroads (AAR), the American Short Line and Regional Railroad Association (ASLRRA), and several railroads. The court concluded that the FRA acted within its authority and rejected arguments that the rule was arbitrary and capricious.


The ruling addresses a challenge brought by industry groups and railroads to one of the FRA's most significant recent safety regulations and provides additional guidance regarding the agency's rulemaking authority.
